1. Purpose of the contract

These Terms and Conditions define the rights and obligations of Nosy Be Rêves de Pêche and its clients in connection with the sale of sport fishing, big game fishing, services in Madagascar, as well as related services. They also set out the conditions governing the use of the website www.nosyberevesdepeche.com

2. Booking and Payment

• Contract: A contract detailing the selected services will be sent to the client. The client must return it signed by email or by post for validation.
• Deposit : A 25% deposit of the total amount is required at the time of booking to confirm the reservation, payable by bank transfer or secure electronic payment.
• Balance : The remaining balance of the total amount must be paid in Nosy Be, no later than 2 days before departure, in cash only, in euros or ariary.
• Extras : Services not included in the original programme will be charged separately and must be paid for before departure.

3. Pricing

• Prices are stated in euros (€) and include all applicable taxes.
• Prices include the services specified in the selected package and destination.

4. Cancellation and changes before departure

Cancellation by the client

• More than 60 days before departure: The deposit will be refunded in full.
• Between 60 and 30 days before departure: 50% of the deposit will be refunded.
• Less than 30 days before departure: The deposit is non-refundable.
• Resale of cancelled services : Nosy Be Rêves de Pêche will make every effort to resell the cancelled services. If they are resold, the deposit will be refunded on a pro rata basis according to the number of days resold, after deduction of administrative and logistical costs.

Cancellation by the organiser

In the event of force majeure, such as adverse weather conditions, natural disaster, illness, death, epidemic, etc., Nosy Be Rêves de Pêche reserves the right to cancel the services. In such a case, all amounts paid will be refunded in full, after deduction of administrative and logistical costs.

5. Weather conditions

During the stay, in the event of adverse weather conditions or unexpected deterioration affecting fishing activities, Nosy Be Rêves de Pêche cannot be held liable, and no compensation or refund will be granted.

6. Liability and Insurance

• Fishing equipment : The client is responsible for any loss of or damage to the fishing equipment made available to them. In the event of damage, the client shall reimburse the value of the lost or damaged equipment, in accordance with the rates set and communicated by Nosy Be Rêves de Pêche.
• Public liability insurance : Clients of Nosy Be Rêves de Pêche are covered by public liability insurance.
• Personal insurance : Clients are strongly advised to take out personal insurance covering sea fishing activities, as well as repatriation insurance.
• Personal belongings: Nosy Be Rêves de Pêche accepts no responsibility for any loss, theft, damage or breakage of the clients’ personal belongings.
• Health and safety: Nosy Be Rêves de Pêche accepts no responsibility for any injury, accident, food poisoning, sting or bite from animals, health issue, or any complication occurring ashore or on board the boats during the stay.
  
  Liability waiver clause – Sport fishing activities
  The Client expressly acknowledges having been informed of the risks inherent in the practice of sport fishing, including, but not limited to, health issues, food poisoning, animal bites or stings, as well as accidents that may occur when using fishing equipment, including, without limitation, lines, hooks, etc. Accordingly, the Client agrees to waive any claim, legal action or proceedings against Nosy Be Rêves de Pêche, its representatives, employees and agents, for any bodily injury or material damage resulting directly or indirectly from participation in these activities.

7. Image rights

Photos and videos taken during the stay may be used for promotional purposes. The prior agreement of the customer will be required and stipulated in the contract.

8. Disputes

In the event of a dispute, only the competent Court of Nosy Be will be empowered to decide, in accordance with the local laws in force. However, in the context of the use of the website, certain provisions of French law and the RGPD may apply.

9. Site presentation

The website www.nosyberevesdepeche.com is the property of Nosy Be Rêves de Pêche, headquartered in Madagascar.
Use of the site implies full acceptance of these terms and conditions of use. Nosy Be Rêves de Pêche reserves the right to modify the conditions of use at any time.

10. Site access

The site is accessible at all times, except in case of technical maintenance. Nosy Be Rêves de Pêche cannot be held responsible for any interruption in service.

11. Intellectual property

All elements of the site (text, images, logo, graphics) are the exclusive property of Nosy Be Rêves de Pêche. Any reproduction, adaptation or use is forbidden without prior written authorization.

12. Limitation of liability

Nosy Be Rêves de Pêche cannot be held responsible for material or immaterial damage linked to the use of the site (e.g. virus, incompatibility of equipment).

14. Applicable law

The www.nosyberevesdepeche.com website is governed by Malagasy law. However, in the event of involvement of the host or a European user, certain provisions of French law and the RGPD may apply.
