They also set out the conditions governing the use of the website <a href=\"https:\/\/nosyberevesdepeche.com\/en\/\">www.nosyberevesdepeche.com<\/a> <\/p><h2>Terms and Conditions of Sale<\/h2><ol start=\"2\"><li><h3>Booking and Payment<\/h3><\/li><\/ol><ul><li>Contract: A contract detailing the selected services will be sent to the client. The client must return it signed by email or by post for validation. <\/li><li>Deposit : A 25% deposit of the total amount is required at the time of booking to confirm the reservation, payable by bank transfer or secure electronic payment.<\/li><li>Balance : The remaining balance of the total amount must be paid in Nosy Be, no later than 2 days before departure, in cash only, in euros or ariary.<\/li><li>Extras : Services not included in the original programme will be charged separately and must be paid for before departure.<\/li><\/ul><ol start=\"3\"><li><h3>Pricing<\/h3><\/li><\/ol><ul><li>Prices are stated in euros (\u20ac) and include all applicable taxes.<\/li><li>Prices include the services specified in the selected package and destination.<\/li><\/ul><ol start=\"4\"><li><h3>Cancellation and changes before departure<\/h3><\/li><\/ol><p>Cancellation by the client<\/p><ul><li>More than 60 days before departure: The deposit will be refunded in full.<\/li><li>Between 60 and 30 days before departure: 50% of the deposit will be refunded.<\/li><li>Less than 30 days before departure: The deposit is non-refundable.<\/li><li>Resale of cancelled services : Nosy Be R\u00eaves de P\u00eache will make every effort to resell the cancelled services. If they are resold, the deposit will be refunded on a pro rata basis according to the number of days resold, after deduction of administrative and logistical costs. <\/li><\/ul><p>Cancellation by the organiser<\/p><p>In the event of force majeure, such as adverse weather conditions, natural disaster, illness, death, epidemic, etc., Nosy Be R\u00eaves de P\u00eache reserves the right to cancel the services. In such a case, all amounts paid will be refunded in full, after deduction of administrative and logistical costs. <\/p><ol start=\"5\"><li><h3>Weather conditions<\/h3><\/li><\/ol><p>During the stay, in the event of adverse weather conditions or unexpected deterioration affecting fishing activities, Nosy Be R\u00eaves de P\u00eache cannot be held liable, and no compensation or refund will be granted.<\/p><ol start=\"6\"><li><h3>Liability and Insurance<\/h3><\/li><\/ol><ul><li>Fishing equipment : The client is responsible for any loss of or damage to the fishing equipment made available to them. In the event of damage, the client shall reimburse the value of the lost or damaged equipment, in accordance with the rates set and communicated by Nosy Be R\u00eaves de P\u00eache. <\/li><li>Public liability insurance : Clients of Nosy Be R\u00eaves de P\u00eache are covered by public liability insurance.<\/li><li>Personal insurance : Clients are strongly advised to take out personal insurance covering sea fishing activities, as well as repatriation insurance.<\/li><li>Personal belongings: Nosy Be R\u00eaves de P\u00eache accepts no responsibility for any loss, theft, damage or breakage of the clients\u2019 personal belongings.<\/li><li>Health and safety: Nosy Be R\u00eaves de P\u00eache accepts no responsibility for any injury, accident, food poisoning, sting or bite from animals, health issue, or any complication occurring ashore or on board the boats during the stay.<br><b style=\"text-align: var(--text-align);\"> <br>Liability waiver clause \u2013 Sport fishing activitie<\/b>s<br>The Client expressly acknowledges having been informed of the risks inherent in the practice of sport fishing, including, but not limited to, health issues, food poisoning, animal bites or stings, as well as accidents that may occur when using fishing equipment, including, without limitation, lines, hooks, etc. Accordingly, the Client agrees to waive any claim, legal action or proceedings against Nosy Be R\u00eaves de P\u00eache, its representatives, employees and agents, for any bodily injury or material damage resulting directly or indirectly from participation in these activities. <\/li><\/ul><ol start=\"7\"><li><h3>Image rights<\/h3><\/li><\/ol><p>Photos and videos taken during the stay may be used for promotional purposes. The prior agreement of the customer will be required and stipulated in the contract. <\/p><ol start=\"8\"><li><h3>Disputes<\/h3><\/li><\/ol><p>In the event of a dispute, only the competent Court of Nosy Be will be empowered to decide, in accordance with the local laws in force. However, in the context of the use of the website, certain provisions of French law and the RGPD may apply. <\/p><h2>General Terms and Conditions of Use (GTCU)<\/h2><ol start=\"9\"><li><h3>Site presentation<\/h3><\/li><\/ol><p>The website <a href=\"https:\/\/nosyberevesdepeche.com\/en\/\">www.nosyberevesdepeche.com<\/a> is the property of Nosy Be R\u00eaves de P\u00eache, headquartered in Madagascar.<br>Use of the site implies full acceptance of these terms and conditions of use.
