  1. Purpose of the contract

These general terms and conditions define the rights and obligations of Nosy Be Rêves de Pêche and its clients in the context of the sale of sport fishing services (big game fishing) in Madagascar, as well as related services. They also set the terms of use of the website www.nosyberevesdepeche.com.

General Terms and Conditions (GTC)

  1. Booking and payment

  • Contract: A contract detailing the services selected will be sent to the customer. It must be signed and returned by e-mail or post for validation.
  • Deposit : A deposit of 25% of the total amount is required at the time of booking to validate the reservation, paid by bank transfer or secure electronic payment.
  • Balance : The balance of the total amount must be paid in Nosy Be, no later than 2 days before departure, in cash only (euros or ariary).
  • Supplements : Services not included in the initial program will be billed separately and must be paid for before departure.

  1. Pricing

  • Prices are quoted in euros (€) and include all applicable taxes.
  • Rates include the services defined in the formula and destination chosen.

  1. Cancellations and changes before departure

Cancellation by the customer

  • More than 60 days before departure : The deposit is fully refunded.
  • Between 60 and 30 days before departure : 50% of the deposit will be refunded.
  • Less than 30 days before departure : The deposit is non-refundable.
  • Relocation of cancelled services : Nosy Be Rêves de Pêche makes every effort to relocate cancelled services. If they are rebooked, the deposit will be refunded in proportion to the number of days rebooked, less administrative and logistical costs.

Cancellation by the organizer

In the event of force majeure (adverse weather conditions, natural disaster, epidemic, etc.), Nosy Be Rêves de Pêche reserves the right to cancel services. In this case, the sums paid will be refunded in full after deduction of administrative and logistical costs.

  1. Weather conditions

During your stay, Nosy Be Rêves de Pêche cannot be held responsible in the event of bad weather or unforeseen deterioration affecting fishing activities, and no compensation or refund will be granted.

  1. Liability and insurance

  • Fishing equipment : The customer is responsible for any loss or breakage of the fishing equipment provided. In the event of damage, the customer must reimburse the value of the lost or broken equipment, in accordance with the rates set and communicated by Nosy Be Rêves de Pêche.
  • Liability Insurance : Clients of Nosy Be Rêves de Pêche are covered by liability insurance.
  • Personal insurance : We strongly recommend that you take out personal insurance covering sea fishing and repatriation.
  • Personal belongings : Nosy Be Rêves de Pêche accepts no responsibility for the loss, theft, damage or breakage of customers’ personal belongings.
  • Health and safety : Nosy Be Rêves de Pêche accepts no responsibility for injuries, accidents, food poisoning, animal bites, health problems or any other complications that may arise on land or aboard the boats during your stay.

    Liability waiver – Sport fishing activities
    The Customer expressly acknowledges having been informed of the risks inherent in the practice of sport fishing, in particular the risks of health problems,
    food poisoning, animal bites or stings, as well as accidents that may occur during the use of fishing equipment (including, but not limited to, lines, hooks, etc.). Consequently, the Customer agrees to waive any claim, legal action or lawsuit against Nosy Be Rêves de Pêche, its representatives, employees and agents, for any bodily injury or property damage resulting directly or indirectly from the practice of these activities.

  1. Image rights

Photos and videos taken during the stay may be used for promotional purposes. The prior agreement of the customer will be required and stipulated in the contract.

  1. Disputes

In the event of a dispute, only the competent Court of Nosy Be will be empowered to decide, in accordance with the local laws in force. However, in the context of the use of the website, certain provisions of French law and the RGPD may apply.

General Terms of Use (GTU)

  1. Site presentation

The website www.nosyberevesdepeche.com is the property of Nosy Be Rêves de Pêche, headquartered in Madagascar.
Use of the site implies full acceptance of these terms and conditions of use. Nosy Be Rêves de Pêche reserves the right to modify the conditions of use at any time.

  1. Site access

The site is accessible at all times, except in case of technical maintenance. Nosy Be Rêves de Pêche cannot be held responsible for any interruption in service.

  1. Intellectual property

All elements of the site (text, images, logo, graphics) are the exclusive property of Nosy Be Rêves de Pêche. Any reproduction, adaptation or use is forbidden without prior written authorization.

  1. Limitation of liability

  1. Applicable law
